You should read these terms carefully before agreeing, as it contains important information about your rights and responsibilities when entering into any contract for service with Element IT. Where applicable, these terms apply to all transactions and work performed by all our technicians.
All references to “you” means the individual or business customer requesting the services and / or goods from us; “we”, “our” or “us” means Element IT; “services" means the services we provide to you as described on our website; “goods” means all products and other goods (including software) supplied by us to you.
Element IT may change this agreement from time to time by updating this page. You should check this page every time you are requesting our services to ensure that you agree with any changes. If you have any questions regarding our Terms and Conditions of Service, please Contact Us.
By accepting service from Element IT you are acknowledging that you have read and understood these terms and conditions and agree to all the terms below. You agree to these service terms and all applicable service fees and or charges.
Onsite Visit/Pick Up or Drop Off Service
- $165 + GST /hr.
- + $50 + GST Call Out
- Minimum 1 Hour
Remote Support/Remote Login Service:
- $165 + GST /hr
- NO Call Out
- Minimum 30 minutes
Diagnosis / Minimum Charge
Minimum charges apply to all support given by Element IT. Our Prices are listed above and published on our website at www.elementit.com.au/prices
A thorough diagnosis of your device / software takes approx. 1-1.5 hours to perform. This will incur a charge at the relevant rates. See prices listed above.
If an appointment is canceled with less than 2 hours notice we reserve the right to charge our minimum fee including call-out fee.
Unless otherwise stated in writing, payment terms are strictly “payment-on-delivery” for all goods and services rendered. For all remote logins and phone support, payment must be made at completion. We accept payment by credit card and direct deposit.
We have a formal debt collection process. If you do not pay our invoice within fourteen(14) days, your contact details will be forwarded to our debt collectors to recover the debt. You may also be liable for additional costs and/or fees. After30 days we have the right to cancel any subscriptions and or services with us. We expect full payment even after termination.
Sundry Expenses/Parking Expenses
Any sundry or additional expenses incurred by us in providing services to you will be added to the invoice. For example, this may include the reasonable cost of parking if you are unable to provide free parking at a convenient distance from your home or place of business. If located in the CBD we recommend providing accurate parking directions to us when you book your appointment.
Any verbal quote given by Element IT is given as a guide based on the limited information given by you, the customer. A verbal quote is intended to give you an estimate of the price and is not an assurance that the product or service will be sold at that price.
Any written quote given by Element IT is not a guarantee that the product or service will be provided at that price. Any written quote is valid for a period of 7days or whilst stock is still available.
Remote Support / Unattended Access
You must accept there are risks associated with the repair or any IT service. Risks could result in damage to your property and potential loss of revenue. It could also mean the loss or corruption of data. You must accept that Element IT Pty Ltd is not liable for such damage or loss.
In the event of unintentional damage to components, peripherals, the screen, or any other equipment regarding your computer we will, whenever possible, replace the damaged component/equipment. However, it may be replaced by a second-hand part. This depends upon the cost of the replacement part and/or equipment and the value of your property.
Element IT Pty Ltd strongly encourage that, if possible, you should do a full backup of data and system prior to any repair or IT service being provided by us.
If your property is not collected within the below timeframe, it will become the property of Element IT Pty Ltd. At this time, we reserve the right to dispose of or use the machine and components or peripherals in any matter we should choose to.
-30 days of notification to collect (and services have not been paid for)
-3 months after date of notification to collect (and the services have been paid for)
We will not share your personal details or discuss any of your personal information with any person not expressly authorised by you unless needed to complete the required work, this may include 3rd party vendors.
Element IT will only backup your data if the service specifically requires this or you request this service. In undertaking a backup, we will endeavour to copy all files and data where possible. We will not be liable for failure to copy data that isin an obscure location. It is the responsibility of you to inform us, should files and folders be in an unusual location on the hard drive.
Element IT only backup user files and folders. The backup does not include programs beyond the standard operation system. Any addition programs will need to be re-installed by the client. We can install your other programs, but it will be for an additional charge.
Your Data Back-Up Obligation
You are responsible for ensuring your data, software and media is backed-up prior to us accessing your systems or technology to provide our services. We are not responsible at any time for any data loss, alteration, or corruption of any such data, software, or media.
Element IT will not be responsible to you or any third party for any breach of any software licence in respect of software provided to us by you to be installed on your computer.
You will warrant that it has a valid licence in respect of such software and shall indemnify Element IT against any loss, damage, costs, harm, or other expense whatsoever arising either directly or indirectly as a result of us installing software at your request.
